Practice Direction No. 2
Service of a Declaration of Claim
Amendment Notice:
Effective January 14, 2025, Practice Direction No. 2 issued on June 8, 2011, is revoked and replaced by Practice Direction No. 2 below.
Rule 40 requires a party that files a Declaration of Claim or a Response to a Declaration of Claim to serve every other party within a certain amount of time, and reads:

40 A party who files a declaration of claim or a response must serve every other party with a copy of that document within 30 days after the day on which it is filed.- Before serving a Declaration of Claim, it must be filed with the Tribunal through its E-Filing application. More information on proof of service and the Tribunal’s E-filing Application can be found at Practice Direction No. 9.
- The Tribunal asks that claimants serve a certified copy of a Declaration of Claim on the respondent, which will be provided to the claimants by the Tribunal through its E-Filing application shortly after the Declaration of Claim is filed.
- The Tribunal would like to inform claimants that service of a Declaration of Claim by fax must be made to the attention of:
